Booking conditions 

In these booking conditions, ‘you’ and ‘your’ means all people named on the booking form and in the holiday party. ‘We’, ‘us’ and ‘our’ means Gill and Brian Cocker, owners of Thie yn Droghad. 

When you book Thie yn Droghad direct with the owners – whether online, via phone/email, or Visit IOM – you are entering directly into a contract with the owners of the property. 

1. Making your booking 

The person making the booking must be at least 18 years old at the time of booking. 

The contract is only effective once: 

  • we receive the completed booking form, and
  • we receive the payment due, and
  • we confirm receipt of the above to you by email

We have the right to refuse any booking before we send a confirmation email. If we do this, we will tell you by email and promptly refund any money you have paid to us. In this case, we will not have any legal responsibility to you. 

2. Payment 

A deposit of 25% is payable when you book. If we cannot accept your booking, we will return this to you. 

We must then receive the rest of the money no less than 6 weeks before your arrival date (8 weeks for TT and Festival of Motorcycling). If you book less than 6 weeks before the start of your holiday, you must pay the full amount when you book. When we receive the balance, we will send you a confirmation email, together with welcome and arrival arrangements. 

If you do not pay any final balance payment due in relation to your booking by the appropriate date, we are entitled to assume that you want to cancel your booking. In this case, we will be entitled to keep all deposits paid. 

3. Cancellation by you 

If you have to cancel your booking, the deposit is non–refundable. If you cancel within 41 days of your arrival date, you forfeit the total cost unless we can re-let the property. If we manage to re-let the property, we will return to you the re- letting price achieved less your deposit. For TT and Festival of Motorcycling, cancellations at any time will forfeit the deposit. We strongly recommend that you take out travel insurance to cover you for cancellation and for your total stay. 

4. Cancellation by us 

We do not expect to have to make any cancellation or changes to your booking. However, in exceptional circumstances (for example, serious repair work needed at the property) we will try to make a suitable alternative booking at another property. If this is not possible, we will refund all sums paid by you for this booking. This will be our only obligation or liability to you in such circumstances. 

5. Force Majeure – events beyond our control 

In the event of any circumstance beyond our reasonable control including, without limitation, an act of God, fire, flood, war or acts of terrorism, that means that the property is not available on the start date of your booking or the property is unsuitable for letting at that time, we shall not be deemed to be in breach of contract but shall refund in full to you all fees, charges and any deposit paid in advance by you. We will not be liable for any other claim for loss or damage by you. 

6. Our legal responsibilities to you 

We cannot be held responsible for noise or disturbance which comes from beyond the boundaries of the property or which is beyond our control. If we know about a problem before you arrive, we will contact you to let you know. We cannot be held responsible for the breakdown of equipment such as boilers, washing machines, nor for the failure of public utilities such as water, gas, and electricity. If you report such a problem during your stay, we will do our utmost to resolve it for you, as promptly as possible. If a contractor needs to enter the property to repair a problem you have reported during your stay, we will give them a key to do so. 

7. Liability 

We accept no liability for any loss, damage or injury to guests, their invited guests, or their belongings including vehicles, motorcycles, and so on. Any liability of the owners to any guest arising in any way out of the booking shall be limited to the actual amount paid by the guest and will not include any consequential loss or damage. 

You must accept responsibility for your own and your children’s safety. Baby equipment, play equipment, any amenities or equipment provided must be used at your own risk. 

8. Arrival and departure 

You can arrive any time after 4 pm on your arrival date. You must leave by 10 am on the last day – this is important to ensure that we have time to get the chalet ready for arrival of the next guests. 

9. Care of the property 

You and all members of your party agree to take care of the property during your stay and to leave the property in a similar condition as you found it when you arrived. We don’t want you to spend the last day of your holiday cleaning, just leave the chalet as tidy as when you arrived so we have time to make sure it’s just as clean for the next guests. 

You and all members of your party also agree to behave in a way at all times while at the property which does not break any law. In addition, you agree not to use the property for any illegal or commercial purpose, including subletting it or otherwise allowing anyone to stay in it who is not listed on the booking form. 

We expect you to show courtesy to the occupants of other nearby properties in particular in terms of noise, parking, and tidiness of any shared facilities such as the access lane. 

We can refuse to allow you into the property or ask you to leave if we reasonably believe you or any member of your party is behaving illegally, or that any damage is likely to be caused, has been caused or is being caused by the behaviour of you or any members or your party. We will treat these circumstances as a cancellation by you. 

We do not take a damage deposit. Instead, we ask that you respect the trust we place in you to look after the property and its contents during your stay. By making a booking you agree to accept responsibility for any damage caused by you or any member of your party and you agree to pay any costs incurred as a result, including extra cleaning costs. We expect minor breakages from time to time and won’t charge for these but please let us know before you leave so we can replace for the next guest. 

This property is non-smoking and under no circumstances must smoking occur inside the property. If evidence of smoking inside is found, a charge of £50 will be made to cover cleaning and any refurbishment costs. 

Pets are not permitted on the property unless by prior arrangement. In these circumstances, you agree to the following conditions: pets must not be allowed onto the furnishings or beds, they must not be left in the property unattended, pets must be kept under control at all times and not allowed to foul anywhere on the premises (any accidental fouling must be removed immediately and the area cleaned). This is to ensure we can make sure the property is always clean and ready for other guests.

10. Right of entry 

We reserve the right to enter the property at any reasonable time for the purposes of inspection, repair work, etc. 

11. Termination of stay 

We reserve the right to terminate your stay if you or members of your party are believed to be causing a nuisance to occupants of nearby properties, or are not treating the property with due respect and care as listed above. 

12. Complaints 

Above all, we want you to have a wonderful time at Thie yn Droghad. If for any reason you have a complaint, please let us know as soon as you can so that we can do something about it and put things right. 

13. Communicating with you 

To process your booking, we will need to collect and process personal information. From time to time we would like to send you by email, information about Thie yn Droghad and the Isle of Man, including special offers and information that we think will interest you. We will first ask for your consent to add your email to our mailing list. You can email at any time to unsubscribe from this list. We will not pass your details onto third parties – unless it’s in circumstances where third parties would need to know your personal information for example, if helping you to contact another service provider, and only to the third-party service provider concerned.
